Terms & Conditions

The following document outlines the terms and conditions for the Sociology Support website.

Terms correct from Sunday 12th January 2020.

Event Terms and Conditions

1             Scope of application

1.1         The following General Terms and Conditions in the applicable version at the time of placing the order shall apply exclusively to the business relationship between Sociology Support (business address 6 Lindley Street, Holgate, York YO24 4JF) (henceforth “Organisers”) and the participants (henceforth “Delegates”) in online webinars. We shall not acknowledge conflicting, different or supplementary general terms and conditions, nor shall these form part of the contract.

1.2         A consumer for the purposes of these General Terms and Conditions means every natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. Participants who take part in our webinars via their employer are not consumers since in this case (for example, if the employer books the seminar for their employees) it is not they themselves but rather their employer who is the contractual partner with the Organisers.

2             Subject matter of the contract

2.1         Sociology Support, via their third party platform (Inset online), offer attendance seminars and online training courses, (henceforth “Events”) which are provided through various forms of teaching and methods of implementation (e.g. a lecture with chat support and discussion in a live webinar format).

2.2         Prices, details and conditions for individual events can be found in the respective product descriptions on the Sociology Support Website and in the online shop.

2.3         The presentation of Events on the Organisers website does not constitute a legally binding offer but instead is an invitation to place an order. The service descriptions do not have the character of an assurance or warranty.

2.4         Unless stated otherwise, all offers are valid “while stocks last”, i.e. until the maximum number of participants is reached.

3             Ordering process and conclusion of contract

3.1         Customers can book an Event on the website. During registration, the Customer must truthfully provide all the requested personal information.

3.2         After payment is received online (or payment through invoice) subsequently the access data for the event shall be sent to the Customer’s e-mail address stated at the time of booking. The Customer agrees to keep this data safe, not to pass it on to unauthorised third parties, and to prevent third parties from gaining access to it. The Customer further agrees to ensure that the data they provide is kept up to date, especially their contact details.

3.3         After payment is received, the Organiser shall send an e-mail confirming that the order has been completed. Only then does a contract come into existence between Organiser and Customer. In this respect Sociology Support Events (seminars / webinars / courses) listed on the website do not constitute an offer in the legal sense.

3.4      When access details to the Event are sent to the Delegate from the third party platform (Inset online), these should not be shared with any other third parties. You will only have one online access point for the webinar. Other colleagues from your own organisation will be able to join with you for the event (e.g. through interactive whiteboard). You cannot use the same log in details in more than one location.

3.5      Cancellation

Withdrawal from a live webinar: Withdrawal from a webinar is possible free of charge until 5 days before the scheduled date. If the booking is cancelled after that time, the participation fee shall not be refunded. (If an audio recording is produced, this will be made available).

Instead of cancelling, Delegate(s) who are unable to attend may elect to appoint a substitute who takes over all rights.

 4             Prices and payment terms

4.1         Participation/booking fees can be found in the product description and do not include VAT at the statutory rate.

4.2         During the order process, the Customer can choose among the available methods of payment.

4.3        If payment by invoice is available, payment is to be made immediately upon receiving the invoice. For all other payment methods, the participation fee is to be paid in advance, at the time of booking.

4.4        If third parties are used to process payment, e.g. credit card, debit card, PayPal their general terms and conditions shall apply.

5             Technical requirements for participation in live webinars

5.1         When taking part in a live webinar, each participant must meet the minimum requirements (internet connection, current browser version, download a program from the webinar platform if necessary, speakers or headset) and test these before the webinar.

5.2         Failure to meet the technical requirements for which the Delegate is responsible does not release the Delegate from the contractual obligation to pay. In so far as a Delegate does not report any technical problems prior/during a webinar and no such notifications are evident from the recording either, participation shall be considered to have taken place.

5.3         The training courses are not offered as a recording. Sociology Support points out that it may not be possible to access the course e.g. due to maintenance or force majeure. However, Inset online (providers of the third party platform) will do everything possible to ensure any technical difficulties are resolved before/during the event.

6             Copyright

6.1         The content of all events and all materials (webinar documents that are made available, etc.) are the intellectual property of Sociology Support and are protected by copyright. They may be used exclusively by the registered Delegate to whom they were made available. Publication even if only in part, reproduction, distribution and editing are prohibited, as is the recording of an event in audio or by means of screenshots. Legal proceedings may be initiated in the event of any misuse.

6.2         The Delegate agrees to respect copyright and only use the live webinar course individually for their own use under the terms of the contractual agreement.

7             Duration and termination of the contract

The duration of the contract is determined by the respective webinar description. The Delegate’s contractual obligations, particularly the obligation to pay, exist regardless of whether the Delegate actually attends the booked webinar.

8             Rescheduling and cancellation of live webinars by Sociology Support

8.1         Sociology Support reserves the right to cancel attendance to events up to 5  days before the appointed time if the minimum number of participants is not reached, unless a different cancellation period is specified in the description on the website / in the online shop. If the event is cancelled for this reason or because of the absence of the presenter(s), force majeure or other unforeseeable events, there is no right to demand that the event be held. Participants shall be informed of the cancellation immediately via e-mail. Fees already paid will optionally be credited for participation in other events or refunded in full. Participants shall not assert any other claims against Sociology Support.

8.2         If the presenter(s) is/are absent, Sociology Support reserves the right to appoint an equivalent Sociology Support presenter. In this case there is no entitlement to a refund of participation fees.

9             Right to cancel

Consumers have a fundamental right to cancel. More information about the right to cancel can be found in this document (please see section 3).

10          Right of withdrawal

10.1       The following possibility of withdrawal from the contract is applicable in addition to consumers’ statutory right to cancel and does not exclude this right. Withdrawal is applicable to delegates who cannot make use of the right to cancel.

10.2       A live webinar booking may be cancelled by e-mail not less than 5 days before the event starts subject to payment of an administration fee of 25% of the participation fee to cover the fees paid to the third party platform providers. In the event of cancellation after this time, no participation fees shall be refunded. Receipt of the notification by Sociology Support shall be decisive.

11          Place of jurisdiction, applicable law, contract language

11.1       The place of jurisdiction and place of fulfilment is the Organiser’s place of business and the Third Party platform provider Inset Online.

11.2       The laws of the UK shall apply. This does not apply if compelling consumer protection regulations preclude such application.

11.3       The contract language is English.

12        Online Dispute Resolution

We are neither obliged nor willing to take part in any consumer dispute resolution proceeding. Our e-mail for complaints from our customers is: info@sociologysupport.co.uk.

Ordering products

Your order

Your order for resources is accepted and a contract is formed between Sociology Support and you when we despatch the resources you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by Sociology Support, nor at the point in time that you receive an email from Sociology Support acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Sociology Support or may be cancelled by you.

Exceptions apply to orders for online electronic resources which cannot be cancelled by you once you have received an email confirmation that your order has been received, as such items and goods may already be in production and being sent as a result of your order. Following formation of the contract, Sociology Support shall continue to own any goods ordered until it has received payment in full from you, even though the goods may have already been delivered to you.

Cancelling your order

Under Consumer Regulations you have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the resources or service. Please be aware that your right to cancel does not apply to online electronic resources that are sent immediately by email. For all printed resources that are posted to you, please inform us of your wish to cancel in writing either by letter, email, or call 01904 918928 within a period of 14 days beginning on the day after the day you receive your resources. You must take reasonable care of the resources and not use them. You should return resources to us in their original packaging, wherever possible, within 14 days of informing us of your wish to cancel. If you return resources to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If resources are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage. See RETURNS section for details of how to return resources to us.

We cannot accept substitute or alternative items by way of returns nor are we able to send them back to you, so please look closely at the items you return to us. If you return or attempt to return substitute or alternative items, you will still be responsible for paying for the original item purchased and we reserve the right to charge an investigation fee of no less than £35 to cover the cost of our investigating the position. We can offset this amount due from other sums that may be due to you for refunds. Accepting returned goods and/or crediting an account does not constitute a waiver of our right to charge an investigation fee. For full details of your rights under the Consumer Protection Regulations, please contact your Citizens Advice Bureau or a Solicitor.

Returns & Refunds

Returns Via Courier

You may return most items in a new and unused condition and wherever possible in the original packaging using the returns label. If you want to cancel/return your order you must tell us within 14 days (beginning on the day after the day you receive the resources), and you then have 14 days to return the items. If you return the whole order the £3.99 delivery charge will be refunded.

Exceptions to the returns policy

The following exceptions apply to our returns policy. Returned items which are not in new or unused condition may not be fully credited to your account unless they are faulty. This does not affect your right to return faulty items.
